N2  - Problematics regarding the relocation of the national capital or IKN is one of the hot discussions at this time, due to the many problematics that surround the issue of moving the national capital. One of them is the formation and ratification of the Law of the Republic of Indonesia Number 3 of 2022 concerning the National Capital, which according to some opinions that Law No. 3 of 2022 concerning the National Capital is considered too hasty in its ratification and formation. This can be seen from the various articles contained in the Law which are considered irrelevant, so that it seems as if it is only a complement in Law No. 3 of 2022 concerning the National Capital and does not take into account the philosophical basis, where the philosophical basis is Pancasila.
The type of research used by the author in this research is library research, which is research conducted by reading books, literature, and reviewing various kinds of theories and opinions that have a relevant relationship with the problem under study. This research is descriptive-analytical, which is a research aimed at obtaining suggestions in overcoming certain problems The approach used in this research is a juridical-normative approach to the IKN Law in its formation there is a degradation or decrease in the values contained in Pancasila as the state philosophy and one of the important aspects in the formation of a legal product in Indonesia that the principles contained in Siyasah Dusturiyah and the values contained in Pancasila are not fully reflected in the formation of the IKN Law.
The results of this research are the need for further studies and research related to the problems that occurred during the process of forming the IKN Law, especially in terms of legal material or substance contained in the IKN Law based on Pancasila and the aspirations of the general public and especially the people affected by the IKN project. The need for a more in-depth study related to meaningful participation so that problems related to the lack of public participation are expected to be resolved so that the IKN Law is able to guarantee justice and the benefit of the community.
