States that if a product circulating and traded in Indonesian territory does not contain haram ingredients, it must be Halal certified. Several regulations that accommodate halal products provide benefits, but in reality the level of awareness of complying with regulations has caused many polemics, especially among Micro and Small and Medium Enterprises (MSMEs) in Banjar City, West Java. According to records from the Department of Cooperatives, Small, Medium Enterprises and Trade in Banjar City, West Java, there are 27,256 MSME processed products. However, the problem is that of the number of MSMEs, at the time this research took place only 5,636 MSME processed products were halal certified. This research is field research located in Banjar City, West Java. By using a qualitative research method that is descriptive analytical in nature, the analysis uses the theory of legal effectiveness from Lawrence Frideman and a sociological review of Islamic law from Atho Mudzhar. This research uses data collection techniques carried out by interviews, observation and documentation. Based on the analysis carried out by the author, it shows that the mandatory halal certification policy in Banjar City, West Java has not been effective enough in its implementation, this is in accordance with Lawrence Frideman's theory of legal effectiveness which states that the legal system consists of three components, namely legal structure, substance law and legal culture, if one of them does not work then it cannot be said to be effective. Then a review of the sociology of Islamic law from Atho Mudzhar, namely the behavior of Islamic society referring to Islamic law. The mandatory halal certification policy in Banjar City, West Java is still responded to variously with a large level of doubt regarding the efficiency, effectiveness, benefits, satisfaction and equity of their products. So far, it has been more widely responded to and implemented as an effort to fulfill business obligations and business opportunities. This mandatory halal certification policy has not been fully accepted with the awareness that halal is a teaching about behavior and a way of life that is clean, healthy, good, and has the value of worship in Islam. So there are still many MSMEs that do not have a halal certificate. Shows that there are literacy and education gaps that need to be addressed among MSMEs in Banjar City, West Java. Thus, the response to mandatory halal certification in Banjar City, West Java is influenced by legal understanding factors.
