This policy allows married couples who have not or have not been registered, to have their marital status listed on the Family Card, namely those whose marital status has not been registered. This creates problems, namely that the inclusion of this status is only administrative in nature and does not have permanent legal force. Then why does this SE regulate the recording of unregistered marital status? and what is this policy when viewed from the relevant laws and regulations and Maq{\=a}{\d s}id asy-Syar{\=i}'ah? This type of research is library search, namely research by collecting data from books, books, scientific works, and so on. With a theme that matches the author's research. The nature of this research is descriptive-analytic, namely explaining the applicable laws and regulations and then linking them to Maq{\=a}{\d s}id Syar{\=i}'ah theories and the practice of implementing positive law related to the problem. The normative juridical approach is an approach based on the main legal material by examining theory, legal principles, as well as Circular Letter of the Directorate General of Population and Civil Registration Number. 472.2/15145/DUKCAPIL. Then with data collection techniques in the form of document studies and qualitative data analysis techniques using inductive methods. Based on the research results as presented in this thesis, it can be seen that: (1) The policy of including marital status not yet recorded on the Family Card is the Government's effort to accelerate administrative completeness for all Indonesian citizens. (2) This policy is in conflict with other related laws and regulations, namely that the policy does not reflect justice, legal certainty and legal benefits. This can be seen in the fact that the status of being unmarried in the Family Card does not have permanent legal force, so that in the future it has the potential to cause negative impacts, such as the child's lineage not referring to his biological father, the status of marital assets being confused, and the like. (3) Based on the analysis of Maqa{\ensuremath{>}}s\}id asy-Syari{\ensuremath{>}}'ah which includes: {\d h}if{\d z} ad-d?n (guarding religion), {\d h}if{\d z} an-nafs (protecting oneself), {\d h}if{\d z} an-nasl (guarding offspring), {\d h}if{\d z} al-m{\=a}l (guarding property) and {\d h}if{\d z} al-'aql (guarding the mind). This policy does not meet the competency of the 5 main elements of Maqa{\ensuremath{>}}s\}id asy-Syari{\ensuremath{>}}'ah, so this policy is not justified according to Maqa{\ensuremath{>}}s\}id asy-Syari{\ensuremath{>}}'ah, because it causes danger/damage to human life.} }
