abstract: As we know that not all humans have a perfect life with normal physical and mental conditions. There are some people around us who have physical, intellectual, mental and/or sensory limitations for a long period of time who in interacting with the environment can experience obstacles and difficulties to participate fully and effectively with other citizens based on equal rights, called persons with disabilities. Persons with disabilities also have the same rights as other people, namely the right to live a normal life such as attending school, working, and having a family. In the marriage of couples with disabilities, the functions and roles in a family that are formed will experience differences with normal couples in general, and there are even things that are not fulfilled. Persons with disabilities who have entered into marriage will certainly not be separated from their obligations as married couples in general. With their limitations, couples with disabilities alumni of the Pundong Disabled Rehabilitation Center also have their own challenges and ways of fulfilling the rights and obligations of husband and wife. Departing from this background, this study was conducted to find out how the efforts made by couples with disabilities alumni of the Pundong Integrated Rehabilitation Center for Persons with Disabilities in fulfilling the rights and obligations of husband and wife and how these efforts are viewed from the maqāṣid syarī'ah perspective.
This research uses a normative-empirical approach, namely analyzing social phenomena from a normative point of view about the efforts of couples with disabilities alumni of BRTPD Pundong in fulfilling the rights and obligations of husband and wife, viewed from the perspective of maqāṣid syarī'ah. This research is descriptive-analytic, and the data presented in narrative form. Then, the author analyzes the data using inductive thinking method, which starts thinking from specific things, then traced to general things.
In seeking to fulfill the rights and obligations of husband and wife, four couples with disabilities alumni of BRTPD Pundong have fulfilled the aspects of maqāṣid syarī'ah at the ḍaruriyyat level, although not fully perfect. There is one couple, namely couple III, who have not fulfilled the maqāṣid aspect of the ḍaruriyyat level, namely the husband's obligation to provide for the family under his responsibility, because they do not have an income.
