abstract: After the enactment of law No. 3 of 2024 on the second amandement to law No. 6 of 2014 on villages second amandement to law number 6 of 2014 concerning villages, the term of office of the villages head is which was originally 6 years has how become 8 years, as stated in article 39 paragraphs (1) and (2) of law number 3 years 2024 reads, “The Villages Head holds an office for 8 (eight) years. Holds office for 8 (eight) years starting from the date inauguration. Head The Villages Head as referred to in paragraph (1) may serve for a maximum of 2 (two) terms. Consecutive or non-consecukutive terms of office”. Among the reasons why the DPR this policy is so that the village head can carry out village development optimally, give that usually after the election the political situation in the village is not condusive. Condusive. Recearchers are intrested in examining the urgency of the policy of extending the term of office or village heads from the perspective or maslahah mursalah. The researcher is intrested in examining the urgency of the policy of extending the term of office of the village head from the perspective of maslahah mursalah.
This research uses a library research method with a literature study. The type of approach used is juridical – normative by taking data drom existing money law studies and sourced from library materials. The primary data source of this research is the main source in islamic law, namely al-Quran and al-Hadist. And in positive law the sources used come from law number 3 of 2024 concerning the second amandement to law number 6 of 2014 concercing villages. Number 6 of 2014 concercing villages. Secondary data sources include laws and regulations invitations, books, scientific journals, as books related to study of villages law or realted to the study of maslahah mursalah.
This research uses the theory of maslahah mursalah. This result of this study indicate that the urgensi and implication of extending the term of office of the village head from 6 years to 8 years as regulated in article 6 of the village law. The urgency and implication of extending the term of office of the village head from 6 years to 8 years as stipulated in article 39 paragraph (1) and (2) of law number 3 of 2024 concerning the second amandement to law number 6 of 2024 concerning villages has a solid purpuse. Considering that the extension of the village heads term office aims to maximize effectiveness of village programs and to reduce the polarization of village communities after elections. Meanwhile, the result of the analysis of the urgency and implication of extending the term of office of the village head in the perspektive of maslahah. The results of the analysis of the urgency and implication of extending the term of office of the village head in the perspective of maslahah mursalah have fulfiled the provisions of principles of maslahah. Whether it is seen from the quality and importance of maslahah, which is included in the category of maslahah tahsiniyah (tersiery).
