This decision changes the age limit for presidential and vice presidential candidates with the additional requirement of experience as state officials elected through general elections. This change has raised debate about the role of the Constitutional Court as a negative legislator and highlighted the potential for violations of the code of ethics by Constitutional Court judges. Using Shimon Shetreet's independence perspective, this study examines the substantive, personal, internal and collective dimensions of the independence of Constitutional Court Judges. This analysis is important for understanding how the Constitutional Court maintains political stability and government legitimacy in Indonesia's dynamic democratic system. This type of research uses library research, with a juridical-normative approach. While the data analysis method used is descriptive-analytical. The method of data collection and compilation uses the library or literature study method. The results of the study show that Constitutional Court Decision No. 90/PUU-XXI/2023 experiences symptoms of non-independence which causes the loss of independence of Constitutional Court Judges. The loss of independence of Constitutional Court Judges substantively, personally, internally and collectively caused by 8 (eight) factors, including; The discriminatory Constitutional Court Decision Number 90/PUU-XXI/2023; Substantive irregularities with the previous decision (Constitutional Court Decision No. 55/PUU-XXI/2023); The judge has a family relationship with the person concerned; The judge has an indirect interest in the person concerned; Uncertain Changes to the Panel of Judges; Internal decisions that are influenced; The flawed Decision File 90/PUUXXI/2023 and; The irregularities of the application for Decision 90/PUUXXI/2023.
