N2  - The problem studied in this marriage leads to how the repetition of marriage
for couples who marry pregnant outside of marriage is because there are still
people who think that the law of remarriage in marriages that are pregnant outside
of marriage is mandatory. When viewed from the juridical side, for the term
repetition of marriage, there must be several factors that cause the repetition of
marriage, including defects in the first marriage process so that a second repetition
of marriage is required. And from the juridical side, there is also the term
marriage renewal or tajdidun nikah which leads to the renewal of the marriage
contract as a form of ihtiyath or prudence.
This type of research is field research (fieldresearch) using a qualitative
descriptive approach. The data sources used are primary data secondary data. The
primary data is the result of interviews with research subjects, while secondary
data is obtained through literature study of books or scientific papers related to
remarriage. The data collection techniques used in this research are observation,
interviews, and documentation.
The results of the study show first: the KUA's view of remarriage for
couples who marry pregnant outside of marriage is whether it must be carried out.
There are no obstacles during the remarriage if both have agreed to remarry.
Second: the reason the community remarries is because it is for the good of the
husband and wife themselves to become pure again. Third : According to Islamic
law, marrying a woman who is pregnant has two views, the first view which states
that it is halal to marry then the second view which states that it is forbidden to
marry.
