This study focuses on analyzing the role of AI as an expert in assisting with academic tasks from the perspectives of positive law and Islamic law. Although positive law in Indonesia does not recognize the concept of analogy in its legislation, Islamic law employs the methods of qiyas and sadd azzari'ah to analyze new phenomena that are not explicitly regulated in the Sharia texts. This research uses a normative juridical approach with qualitative analysis methods. In Islamic law, the theory of qiya>s is applied to equate AI cases with similar situations regulated by Sharia, while Sadd az|-z|ari'ah is used to close loopholes that could lead to legal or ethical violations. On the other hand, positive law in Indonesia emphasizes written rules without analogy, making the role of AI as an expert in academic tasks complex and requiring more specific regulation. The results of the study indicate that in Islamic law, AI is more appropriately seen as a tool rather than an expert with full authority in completing academic tasks. The use of AI can be leveraged to support the academic process as long as it does not violate ethical principles governed by Sharia. Meanwhile, in positive law, clearer regulations are needed to set boundaries on the use of AI in the academic context to prevent misuse that could harm academic integrity %Z Pembimbing: Mu’tashim Billah, S.H.I., M.H.
