Higher order thinking skills (HOTS) mengarahkan peserta didik untuk tidak sekedar menghafal materi, melainkan secara aktif menganalisis, mengevaluasi, dan menciptakan solusi untuk menunjukkan penguasaan belajar mereka. Untuk menilai ketercapaian HOTS peserta didik, dibutuhkan instrumen tes berorientasi HOTS. Penelitian ini dilakukan untuk menghasilkan instrumen tes berorientasi HOTS berbentuk pilihan ganda bertingkat (two tier multiple choice) pada Materi Jual Beli, mata pelajaran Fikih yang memenuhi kriteria valid, reliabel, dan memiliki tingkat kesukaran yang bervariasi.\r\nJenis penelitian yang digunakan yaitu penelitian dan pengembangan (Research and Development), menggunakan model pengembangan formative evaluation Tessmer (1993) dengan empat tahapan, yakni preliminary, self-evaluation, prototype dan field test. Data kualitatif pada tahap preliminary, self-evaluation, dan prototype (one-to-one dan small group) dianalisis secara deskriptif, sedangkan data kuantitatif hasil field test dilakukan melalui analisis butir soal yang mencakup uji validitas, reliabilitas, dan tingkat kesukaran menggunakan Item Response Theory (IRT) berbantuan model RASCH. Instrumen tes berorientasi HOTS yang berhasil dikembangkan pada penelitian ini terdiri dari 25 butir soal.\r\nHasil validitas menunjukkan ke-25 butir soal valid dari aspek konten, konstruk maupun bahasa. Uji reliabilitas menggunakan SPSS, KR-20, dan JMetrix menunjukkan hasil sama, yaitu instrumen tes berorientasi HOTS yang dikembangkan memiliki reliabilitas sangat tinggi. Dilihat dari tingkat kesukaran butir soal, terdapat 5 butir soal atau 25% yang sukar, 1 butir soal atau 3,3% sedang, dan 19 butir soal atau 63,3% yang mudah.
