abstract: The simultaneous national regional elections in 2024 will have an impact on the vacancy of regional head positions, both governors and regents/mayors. A total of 271 regions experienced vacancies in regional head positions. During this vacancy period, the government took action by appointing regional head officials to ensure that the wheels of government would continue to run until the 2024 simultaneous local elections were held. However, the appointment of regional head officials caused polemics in the community, because the appointment unilaterally did not involve the community and violated democracy so that prone to abuse of power. From the description above, the author is interested in examining how Siyasah Syar'iyah's analysis of the appointment of regional head officials during the vacant regional head position.
This research is a normative legal research (normative juridical), namely approach research that is carried out based on the main legal materials by examining the theories, concepts, and legal principles as well as laws and regulations related to this research. With a descriptive research nature that aims to describe a problem using a statutory approach (statue approach) and a conceptual approach (conceptual approach). Then the research data was collected through reading the text then described and analyzed using the theory of huqhq ar-rai'iyah from siyasah syariyah science.
The results of this study are: 1) The 2024 simultaneous regional elections have several impacts, namely the 2024 simultaneous regional elections have the potential for fraud by government officials for the benefit of individuals or groups, because officials are appointed by the central government without any public participation at all. In addition, it will also affect the quality of democracy in Indonesia due to the large number of regions led by regional head officials. 2) In the concept of siyasah syar'iyah there is a correlation and differentiation of the appointment of regional head officials. The correlation between the appointment of regional head officials and siyasah syar'iyah includes, the appointment of officials is needed because it is to avoid vacancies in the position of regional head in accordance with siyasah syar'iyah. While the defension of the appointment of regional head officials lies in the mechanism for determining and appointing regional head officials that is not in accordance with huquq ar-rai'yah. Where there are restrictions on the rights of the community in determining their regional leaders.
