"This research analyzes the decision of the Yogyakarta Religious Court in case\r\nnumber 239/Pdt.G/2019/PA.YK regarding the granting of a request for a polygamy\r\npermit on the basis of a sirri marriage. A husband wants to formalize his sirri\r\nmarriage which has existed for approximately 10 years. In this case, the author\r\nexamines the basis and consideration of the judge in granting the request for\r\npermission for sirri polygamy from the perspective of maslahah mursalah.\r\nThis research is field research or field research which is descriptive-analytic\r\nin nature. This research aims to determine the extent to which the judge's decision\r\ncan provide benefits by analyzing it using the maslahah murlah theory. The primary\r\ndata source for this research is the decision of the Yogyakarta Religious Court\r\nNumber 239/Pdt.G/2019/PA.YK.\r\nThe results of this study show that even though it is contrary to SEMA\r\nregulation no. 3 of 2018 concerning the Implementation of the Formulation of the\r\nResults of the 2018 Supreme Court Chamber Plenary Meeting as Guidelines for the\r\nImplementation of Duties for the Court, however, the judge's considerations in\r\nhanding down decisions are in line with the concept of maslahah murlah.
