%T TINJAUAN MASLAHAH MURSALAH TERHADAP PERMOHONAN IZIN POLIGAMI ATAS DASAR NIKAH SIRRI (STUDI PUTUSAN NOMOR 239/Pdt.G/2019/PA.YK)
%X This research analyzes the decision of the Yogyakarta Religious Court in case
number 239/Pdt.G/2019/PA.YK regarding the granting of a request for a polygamy
permit on the basis of a sirri marriage. A husband wants to formalize his sirri
marriage which has existed for approximately 10 years. In this case, the author
examines the basis and consideration of the judge in granting the request for
permission for sirri polygamy from the perspective of maslahah mursalah.
This research is field research or field research which is descriptive-analytic
in nature. This research aims to determine the extent to which the judge's decision
can provide benefits by analyzing it using the maslahah murlah theory. The primary
data source for this research is the decision of the Yogyakarta Religious Court
Number 239/Pdt.G/2019/PA.YK.
The results of this study show that even though it is contrary to SEMA
regulation no. 3 of 2018 concerning the Implementation of the Formulation of the
Results of the 2018 Supreme Court Chamber Plenary Meeting as Guidelines for the
Implementation of Duties for the Court, however, the judge's considerations in
handing down decisions are in line with the concept of maslahah murlah. In the
considerations, the judge took into account the benefits of the parties involved in
this case.
