"Currently, precisely in Rubaru Village, Rubaru District, Sumenep Regency has\r\nexperienced a vacancy, in the government system if there is a vacancy in a\r\ngovernment, the local sub-district head/regent is obliged to find a replacement for\r\nthe village head leader when there is a vacancy. The vacancy began with a dispute\r\nin the results of the village head election, the simultaneous elections on April 22,\r\n2022 in Rubaru village, Rubaru District, Sumenep Regency, from one of the\r\ncakades sued for fraud committed by one of his rival cakades who had passed away\r\nbefore the implementation of the village head election and managed to excel in the\r\nvote provocation, which eventually resulted in the Regent of Sumenep appointing\r\nPJ as a replacement until the implementation of the next regional elections. This is\r\na concern for researchers, so the researcher conducted a study on the Juridical\r\nStudy of Disputes over the Results of the Village Head Election (Case Study in\r\nRubaru Village, Rubaru District, Sumenep Regency).\r\nThis research is included in qualitative research with a juridical-empirical\r\napproach. Research data collection techniques are sourced from interviews,\r\nobservations, and documentation. The data analysis used is a qualitative\r\ndescriptive method where the author combines two primary data obtained in the\r\nfield, compiled, described, and explained in a systematic, logical, efficient, and\r\neffective manner. The theories used are the theory of democratic legislation, and\r\nthe theory of Siyasah Syar'iyah.\r\nBased on the results of the study, it was determined that the procedure for\r\nthe implementation of the village head election in Rubaru Village, Rubaru District,\r\nSumenep Regency in 2021 was in accordance with Law Number 6 of 2014\r\nconcerning Villages. The settlement of disputes over the results of the village head\r\nelection in Rubaru Village from the perspective of Siyasah Syar'iyah is ideal. This\r\nis evidenced by the decision of the Surabaya Administrative Court in reviewing and\r\ndeciding disputes based on the main function of the judiciary and reflecting the role\r\nof Siyasah Qadha'iyah."^^ .
