abstract: Marriage is the inner and outer bond between a man and a woman as husband and wife to form a happy and eternal family (household) based on the almighty God. Sometimes marriage is not as expected, marriage can also experience divorce or the breaking of marital ties caused by several factors so that marriage cannot continue. The object of research at the Sleman Religious Court, from the divorce cases that occurred at the Sleman Religious Court, is still very high, with divorce data from 2020-2022, the number of divorces and contested divorce, divorces amounted to 1329 while contested divorces 3817, meaning that contested divorce is more than divorce. Some alternatives to resolving divorce problems that occur are to reconcile and find a way of agreement by the parties through the mediation process at the Sleman Religious Court and assisted by a third party (mediator).
This type of research is field research with descriptive analytical research. The approach used is normative-juridical, with data collection methods: observation, interviews, and documentation. Qualitative data analysis with inductive method, namely exploring specific data to a general conclusion.
The results of the research on the role of the mediator in the implementation of mediation in the Sleman Religious Court are still not optimal and the mediator in the implementation of mediation is in accordance with PERMA No. 1 of 2016 concerning mediation procedures in court. The maslahah mursalah review of the mediator's role, the mediator upholds the goals of goodness and benefit by paying attention to the five basic principles of maslahah al-Daruriyah in maintaining religion, soul, mind, offspring and property. The low success of mediation is due to the difficulty of achieving reconciliation due to the accumulation of problems, feelings of deep hurt, and lack of understanding of religious knowledge, also divorce occurs due to third parties, the economy, the nature of breeding (permissiveness) does not respect the sacredness of marriage, emotionally unstable, still a period of matching. The mediation model used is a religious approach or lecture, heart approach, psychological and caucus.
