%T ANALISIS PENEGAKAN HUKUM TERHADAP PRAKTIK MONEY POLITIC DALAM PEMILIHAN CALON ANGGOTA LEGISLATIF DPRD KABUPATEN LAMPUNG TIMUR DALAM PEMILU 2024
%X The practice of using money (money politics) in elections/promoting and obtaining people's votes in the election of legislative candidates has become an important and curial issue, involving all groups of people in Indonesia. Cases that are still rampant show that existing law enforcement is still less effective, less deterrent and less than optimal. The reasons that have implications for the mushrooming of this include the lack of legal culture itself, ineffective law enforcement, and the need for a legal culture from the community itself.
This research is a qualitative descriptive field research with an empirical approach using the basic basis in the form of applicable laws and regulations and applied in people's lives. The technique for data collection is carried out by observation, direct interviews and documentation.
The results of this study concluded that: first, the Bawaslu of East Lampung Regency as a general election supervisory institution, in the East Lampung region has made efforts to enforce the law on money politics. The efforts made are in accordance with Law Number 7 of 2017 concerning general sorters. However, law enforcement of money politics practices is not easy for Bawaslu to do, there are still many factors that affect the practice. Second, the qodha'iyyah institution that decides a case on the basis of legal force, in addition to Bawaslu, also has a supervisory function that is in harmony with al-hisbah in supervising violations and maintaining public order. These two functions show that Bawaslu combines supervisory and judicial functions in a single institution and reflects the concept of fiqh syiasyah qodha'iyyah in the enforcement of election law.
