abstract: Social dynamics and changes in religious understanding have affected interpretation of Islamic law on divorce, especially in the context if giving talak. The practice of thak three in the traditions of classical Islamic law has led to a long debate amog clerics and legal practioners. The multilateral phenomenon considered final and cable phenomena have complex legal and social consequences for couples. Some of the jurisprudence and judicial decisions reflect a new tendency to interpret talak, which no longer has a rigid and absolute one. The case study at the courts of unfortunate religion provided a unique perspective on the transformation of family law. Ruling number 148/Pdt.G/2020/PA/Kab.Mlg becomes a concrete representation of thr Islamic law dynamics that is responsive to social change. The study attempts to explore how the judge’s judgment is based not only on the normative text but also on the sociological aspects surrounding divorce cases.
Leaving from that, the study would like to see the sociological factors that influenced the judge/s decision to change talak status of three to talak one and analyze the sociology of law in a judge’s consideration change talak status of three to talak one in the court of unfortunate religion. To address the problem, the study would approach legal sociology whith roscoe pound’s social engineering theory. As for this study includes library research or literature studies by examining literature sources dealing with talak issues in islamix law and religious judicial practice.
The result of this study was: first, the sociological factor that influenced the judge’s decision to change the status of three talak to one of the educational and social factors, the family economic factors, the cultural and cultural factors, the religious understanding factor and the social environment factor. Second, social engineering Roscoe Pound gives a critical perspective to understanding the dynamics of law in society. Poor religious court ruling number 148/Pdt.G/2020/PA/Kab.Mlg is concrete proof of how laws can become responsive, humane, and justifiable instruments of social transformation.
