N2  - The enforcement of electoral law in Indonesia often encounters challenges, particularly the discrepancy between the ideal concept and practical implementation, especially concerning the role of Sentra Gakkumdu. This discrepancy includes the lack of investigative authority for Bawaslu and inefficient inter-agency coordination. As an institution tasked with overseeing and resolving electoral violations, Bawaslu's role remains limited due to the requirement of coordination with the police and prosecutors in Sentra Gakkumdu. Consequently, case resolution is frequently hindered, potentially undermining public trust in Indonesia's democratic system.
This study employs a qualitative method with a juridical-normative approach to explore the complexity of the issue. By utilizing Lawrence M. Friedman's legal system theory and Al-Mawardi's concept of Al-Hisbah, the research analyzes the legal enforcement discrepancies in Sentra Gakkumdu and proposes an alternative solution by granting Investigator Civil Servant (PPNS) authority to Bawaslu. Data was gathered through a literature review, encompassing academic references, legislative documents, and empirical reports.
The results reveal that Sentra Gakkumdu has not been effective in addressing electoral crimes due to limited authority and coordination. This study recommends dismantling Sentra Gakkumdu and establishing PPNS under Bawaslu, inspired by similar practices in other institutions. The concept of Al-Hisbah is relevant for creating a supervisory model based on amar ma'ruf nahi munkar, aimed at preserving justice and electoral integrity.
