N2  - This study focuses on the topic "The Use of Economic Evidence as a Consideration in Resolving Business Competition Disputes at the Business Competition Supervisory Commission (KPPU)." It also examines Jasser Auda's Maqasid Shariah perspective on the use of such evidence. The study arises from the issue of legal uncertainty regarding the use of economic evidence as proof in deciding cases of violations of Law No. 5 of 1999 on Prohibition of Monopolistic Practices and Unfair Business Competition. This legal uncertainty stems from the fact that many KPPU decisions are often deemed invalid by other courts. The use of economic evidence as proof is not explicitly included in Article 42 of the Competition Law, which specifies types of evidence, namely: witness testimony, expert testimony, documents, indications, and statements from business actors.
This research is a library study with a descriptive-analytical nature. The data was collected through literature review using a normative juridical approach. All collected data were analyzed using the Theory of Evidence and Maqasid Shariah.
The results of the study show that the use of economic evidence as proof holds strong legal validity, as it is classified under indicative evidence. This is supported by Article 72 of
KPPU Regulation No. 1 of 2010, which states that indicative evidence includes knowledge obtained and believed to be true by the commission panel. Furthermore, Furthermore, Article 57 Paragraph 2 of the Business Competition Supervisory Commission Regulation No. 1 of 2019 states that indicative evidence may consist of economic evidence and communication evidence, which the Commission Panel deems credible.from the perspective of Jasser Auda's Maqasid Shariah, the use of this evidence aligns with Islamic law and promotes the public good. This is evident through a systematic approach emphasizing cognitive aspects, integrity, openness, interrelated hierarchies, multidimensionality, and purposeful relevance.
