N2  - Marriage is an important goal in Islam that it hopes to bring about a happy, harmonious family. Still, problems often lead to divorce, although religion hates this act. Islam offers the solution of divorce as a final solution after a peaceful effort has failed. To address that challenge, the 2016 perma no.1 issue discussed one of its intended mediation procedures was to reduce the divorce rate. He said the rupiah was expected to continue to strengthen to rp9,100 per dollar in the Jakarta interbank spot market on Tuesday. The study aims to find out the effectiveness of the mediation process in reducing the divorce rate in north Jakarta religious courts.
The study uses a normative-and-theological approach. This type of research is a field research field with an analytic descriptive nature supported by data interviews. The study was conducted directly at north Jakarta religious court to collect a descriptive data that describes the phenomenon experienced by the research subject. The study is a qualitative study with a deductive method focused on the data analysis mediating the north Jakarta religious court based on two possible framework theories: the efficacy of law and sociology of islamic law.
The study indicated that the implementation of the mediation at the north Jakarta religious court in 2023 was effective enough to result in 322 things (65.98%) mediating from 488 cases and ending 19 things in peace. According to analysis of the law's effective effectiveness theory, the five factors presented by soerjono soekanto show that the five factors are effective and sufficient, supporting mediation success is its own law factor (perma no.1 in 2016) But law enforcement factors (competence mediator) and community (the litigation) were the most influential factors in achieving successful mediation at the north Jakarta religious court in 2023.
