"BPRS Bhakti Sumekar Masalembu Branch Office (BPRS BS KC.\r\nMasalembu) provides working capital financing facilities to support community\r\nbusiness development. However, in practice, several irregularities were found that\r\ncould potentially hinder the achievement of these objectives. These deviations\r\ninclude combining murabahah and wakalah contracts together, using financing\r\nfunds that are not in accordance with the side streaming contract, providing\r\nfinancing facilities based on fictitious collateral, and defaults committed by\r\ncustomers. These findings indicate less than optimal compliance with DSN-MUI\r\nFatwa No.04/DSN-MUI/IV/2000 on Murabahah, as well as the need to improve the\r\napplication of the precautionary principle in the management of working capital\r\nfinancing.\r\nThis research uses a qualitative method with a descriptive approach.\r\nPrimary data was collected through direct interviews with the UMKM division,\r\nHead of BPRS BS KC. Masalembu, Account Officer (AO), customers, and reviewing\r\nrelated documents. Meanwhile, secondary data was collected from various sources,\r\nsuch as scientific journals, books, regulations, fatwas, and other relevant literature.\r\nCollaboration of primary and secondary data was conducted to obtain a\r\ncomprehensive analysis. Primary data is used to identify the main problems that\r\noccur in the field, while secondary data helps explain and answer these problems\r\ntheoretically.\r\nThe results showed that the implementation of murabaha financing at BPRS\r\nBS KC. Masalembu still faces several obstacles, especially in the application of\r\ncontracts that are not in accordance with the provisions of Fatwa DSN-MUI. In\r\naddition, the risk of misuse of side streaming financing funds is also caused by the\r\nlack of in-depth analysis of the prospective customer's character, the urgent\r\nsituation experienced by the customer, and the maximum lack of supervision and\r\napplication of the prudential principle by the bank. This causes the utilization of\r\nfinancing facilities to often not be in accordance with the contract agreed between\r\nthe bank and the customer."^^ . "2025-01-24" . . . .
