"This study aims to explain the dynamics of enforcing jarimah\r\nzina (the crime of adultery) in Banda Aceh by analyzing how cultural\r\nidentity influences law enforcement, constructs ambivalent attitudes,\r\nand shapes the negotiation efforts undertaken by alleged perpetrators\r\nof zina with the community and law enforcement officials. This\r\nresearch also reveals the knowledge base of the community in\r\nenforcing the law and their tendency to be more reactive toward\r\njarimah related to acts of zina compared to other offenses regulated\r\nunder Qanun Jinayat.\r\nThis study employs a legal anthropology approach, with\r\nresearch conducted in four gampong (villages) in Banda Aceh. Data\r\nwere collected through interviews with informants, including the\r\ngeneral public, academics, government officials, and law enforcement\r\nofficers, as well as through documents related to the enforcement of\r\njarimah zina in Banda Aceh. The field data—including interview\r\ntranscripts, documentation, observations, and other literature\r\nreferences—were analyzed using a conceptual framework developed\r\nbased on Pierre Bourdieu’s theory of habitus and Lawrence M.\r\nFriedman's theory of the legal system.\r\nBased on the collected data, this study presents several key\r\nfindings. First, cultural identity constructs ambivalent attitudes within\r\nsociety, as there is a prevailing belief that asoe lhok (indigenous\r\nresidents) have the authority to safeguard the reputation of the\r\ngampong. Consequently, they take firm action against those suspected\r\nof violating sharia in their area. Analyzing cases processed by law\r\nenforcement authorities reveals that all prosecuted offenders were\r\nureung tamong (outsiders) in the gampong where the incident\r\noccurred, despite evidence that asoe lhok individuals were also\r\ninvolved. The concept of top male (concealing disgrace) explains why\r\ncases involving asoe lhok are not legally processed, as the community\r\nis reluctant to disclose such cases to the public. Second, the enforcement of jarimah zina in Banda Aceh\r\nillustrates a dynamic negotiation process between alleged offenders,\r\nthe community, and law enforcement authorities, rooted in the cultural\r\nand social dynamics of the region. These negotiations are not\r\nunidirectional, leading to diverse legal outcomes, including\r\nresolutions at the gampong level, formal processing by law\r\nenforcement, or informal settlements that completely bypass formal\r\nlegal procedures. Third, the low level of public knowledge about\r\nQanun Jinayat contributes to ambivalence in enforcing jarimah zina.\r\nOn the one hand, society believes that every case of zina should result\r\nin caning punishment. On the other hand, their limited understanding\r\nof formal legal procedures makes them more inclined to resolve zina\r\ncases informally. This attitude is also influenced by their lack of trust\r\nin law enforcement authorities. As a result, the legal behavior of Banda\r\nAceh’s residents is shaped more by local social and cultural norms\r\nthan by the regulations outlined in Qanun Jinayat.\r\nFurthermore, zina is perceived as harming the family institution,\r\nwith consequences not only for the perpetrators but also for their\r\ndescendants. This is reflected in the term aneuk bajeung used in\r\nAcehnese society to describe children born from zina. However, this\r\nstigma does not apply to other jarimah, such as gambling or alcohol\r\nconsumption, which do not directly affect lineage and inheritance.\r\nThis study contributes to the discourse on legal reform in Indonesia,\r\nparticularly in culturally complex regions such as Aceh."^^ .
