MUI as an institution that has the task of fostering and protecting Muslims in Indonesia has issued a 1997 MUI Fatwa on Islamic Shari'ah Guidance in Behaving, Associating and Caring for HIV/AIDS Patients, which recommends that husband and wife who suffer from HIV/AIDS not have offspring as an effort to stop the spread of HIV. The Indonesian government currently has a Prevention of Mother-to-Child HIV Transmission (PMTCT) Program that has been proven to reduce HIV transmission from mother to child to a percentage of transmission of only 1-2%. This study aims to analyze the 1997 MUI Fatwa and the PPIA Program from the perspective of Imam Syatibi's maqasid shari'ah and to know the relevance between the 1997 MUI Fatwa and the PPIA Program. This research is a type of literature study research, which is descriptive analysis with a normative approach. Primary data is obtained through the book of the Indonesian Ulema Council Fatwa Set and the book of HIV Transmission Prevention Program Management Guidelines, and secondary data is obtained through laws and regulations, books, and other scientific works that are in line with this research. Qualitative data analysis using inductive method by using maqasid shari'ah theory and review of saz al-zari@'ah. The results of this study indicate that the basis for the issuance of the 1997 MUI Fatwa regarding the recommendation not to have offspring in a husband and wife with HIV is in accordance with the concept in maqasid shari'ah and the principle of saz al-zari@'ah. However, after the PPIA Program from the Government of Indonesia, the MUI Fatwa is no longer relevant, because the purpose of the PPIA Program is to prevent transmission of HIV from mother to child and improve the quality of life of both.
