%X After the enactment of Law Number 21 of 2023 as a replacement law number 3 of 2022 concerning the National Capital (IKN), which brings significant changes, one of which is the granting of land rights for 190 years for the development of IKN. This policy regulates the extension of land rights, which had never been addressed in the long term before. In this case, the 190-year land tenure policy becomes an important aspect that needs to be considered in the context of land management for infrastructure development and economic zones in IKN. The granting of land rights for such a long period is expected to provide legal certainty and attract investment, but in reality, it has garnered much controversy from both the formation and impact sides of this policy. This research seeks to address the formulation of the problem, namely how the 190-year land rights policy in the Capital City Law (IKN) is based on public policy theory? the 190-year land rights policy in the Capital City Law (IKN) based on the maslahah mursalah theory?
This research is a library research with a qualitative research type. The method used is descriptive analysis with a juridical-normative approach. Data collection was conducted through secondary data, which consists of primary legal materials in the form of legislation and secondary legal materials in the form of legal articles as well as tertiary legal materials. This research uses public policy theory and the theory of maslahah mursalah.
Based on the research framework conducted, the research results include 2 (two) conclusions as findings in the development of Islamic constitutional law studies. The first finding explains that in public policy theory, the 190-year policy has less favorable impacts on the people and that this regulation conflicts with many other rules. The second finding, the perspective of maslahah mursalah on land rights allocation, shows that in determining this policy, it must consider how social justice applies in Islam and in society, and this policy must minimize the potential for agrarian conflict.
