As explained in article 22E paragraph (2) of the 1945 Constitution states that "general elections are held to elect members of the House of Representatives, the Regional Representative Council, the President and Vice President, and the Regional House of Representatives". The Indonesian state has held elections 13 times since 1955-2024. The electoral system used in elections in Indonesia is a closed proportional system and an open proportional system. The open proportional system that is currently in place faces various challenges that have the potential to disrupt political and state stability. Some of the problems that arise in this system include weak party control over its cadres, the loss of political party ideology, high election costs, money politics practices, and increasing corruption rates. These problems can trigger conflicts in government and society, as well as undermine the quality of democracy in Indonesia. This research is a type of normative and descriptive legal research - analysis using normative juridical analysis and a statute approach in examining regulations related to research legal issues, a historical approach, in examining the history of the electoral system in Indonesia and a conceptual approach in examining regulations related to research legal issues and in analyzing research. Based on the data source of primary legal materials of the 1945 Constitution, Law Number 7 of 2017 concerning General Elections and secondary legal materials collected from legal literature and academic journals. The theoretical framework used includes Democracy and General Elections as an analytical knife to find answers to research. The results of the study show that from the results of the comparison between the closed proportional system and the open proportional system, it can be seen that the closed proportional system is better used in the electoral system in Indonesia by looking at several factors in the election in order to make political stability. To realize the implementation of a closed proportional system in legislative elections, one of the steps that needs to be taken is to submit a judicial review to the Constitutional Court against Article 168 paragraph 2 of Law Number 7 of 2017 concerning Elections. This is expected to restore a more stable, democratic, and people's welfare system, not just people's sovereignty.
