"Law enforcement in Indonesia continues to be marked by\r\ndisparities in the application of justice principles, particularly in\r\nmurabahah financing cases involving the execution of mortgage\r\nguarantees in religious courts. The public is often faced with the reality\r\nthat legal decisions tend to prioritize legal certainty over substantive\r\njustice. In the context of religious courts, especially in sharia economic\r\ncases, disparities in judicial decisions frequently arise, directly affecting\r\nthe protection of rights and the sense of justice for those seeking legal\r\nredress.\r\nThis research is a qualitative study employing a philosophical\r\napproach, using John Rawls’ theory of justice as the main analytical\r\nframework. The primary data is derived from religious court rulings\r\nconcerning the execution of guarantees in murabahah contracts,\r\nexamined in depth through document study and content analysis.\r\nAdditionally, secondary sources such as books, academic journals, and\r\nrelevant regulations were utilized. This study analyzes how judges\r\nconsider the principle of justice in making decisions and how John\r\nRawls’ principles can be implemented in the context of Islamic economic\r\nlaw.\r\nThe findings reveal differences in preference and legal reasoning\r\namong judges in resolving cases related to the execution of guarantees\r\nin murabahah contracts. Some rulings tend to reflect distributive justice\r\nby considering the property rights of third parties, while others\r\nemphasize formal legal procedures. This inconsistency highlights the\r\nneed to strengthen the understanding of justice theory among judges, so\r\nthat decisions not only meet legal formalities but also reflect a\r\nsubstantive sense of justice for all parties involved."^^ .
