"The existence of local regulations with Shari'ah nuances in\r\nIndonesia, including in Indramayu Regency and Tasikmalaya City,\r\nhas generated controversy in the community. The pro group states\r\nthat local regulations with Shari’ah nuances can assist the\r\ngovernment in fostering religious life and implementing the mandate\r\nof the first principle of Pancasila and the 1945 Constitution. This\r\nkind of thinking is not in line with the cons, where the application of\r\nlocal regulations on Shari’ah or local regulations with Shari’ah\r\nnuances is a form of violation of statutory provisions because it is\r\nnot in accordance with the ideology of Pancasila, the 1945\r\nConstitution, and the Unitary State Form. In addition, Shari’ah local\r\nregulations will lead to discriminatory attitudes and national\r\ndisintegration. Based on this background, there is a problem. How is\r\nthe legislative process of local regulations with sharia nuances in\r\nTasikmalaya City and Indramayu Regency from the perspective of\r\nlocal legal politics? What are the factors that influence the issuance\r\nof local regulations with sharia nuances? How is the application of\r\nlocal regulations with sharia nuances from the perspective of\r\nMaqāṣid Asy-Syarī‘ah?\r\nThis research is a field study based on local regulations with\r\nsharia nuances in Tasikmalaya City and Indramayu Regency, West\r\nJava, using qualitative methods and taking several local regulations\r\nwith sharia nuances, using a statute approach, and a legal\r\nsociological approach. The local regulations with sharia nuances are\r\nanalyzed with the theory of regional legal politics and the Maqāṣid\r\nAsy-Syarī‘ah theory.\r\nThe research results are: First, juridically normative, the legislative\r\nprocess of Sharia Nuanced Local Regulations in Tasikmalaya City\r\nand Indramayu Regency has gone through stages that can be\r\nconsidered not contrary to the prevailing laws and regulations.\r\nSecond, the factors that influence the issuance of local regulations\r\nwith sharia nuances are: a). the factor of the majority Muslim\r\ncommunity (traditional) and its strong desire to preserve Islamic\r\nvalues in social life; b). the socio-political factor of Islam, which is strongly influenced by the dynamics of religious community\r\norganizations; and c). the factor of the times and modernization\r\ncausing social change. Thirdly, there are some local regulations with\r\nSharia nuances that are in accordance with Maqāṣid Asy-Syarī‘ah\r\nand some that are not. Sharia local regulations must provide\r\nharmony, justice, and benefit. The novelty found by the author is the\r\nconcept of harmonization of sharia and law in the formation of\r\nregional policies, which means that the formalization of Islamic\r\nsharia in the formation of regional policies as political products must\r\nharmonize aspects of sharia and legal aspects in order to bring justice\r\nand benefit all humans (li mashalih al-ibad). This concept is in line\r\nwith Kuntowijoyo's theory of objectification, which says that\r\nlaws (regional policies) must be more grounded in responding to\r\nand solving concrete and real problems that exist in society."^^ .
