%X Intellectual property rights provide legal protection for creators of their intellectual works, including book copyrights. The rampant copyright infringement, especially in the form of book piracy, is still a serious problem in Indonesia. Shopping Book Center in Yogyakarta is one of the popular book shopping centers among the public, but behind its popularity there is a phenomenon of pirated book sales that is quite worrying. This study aims to examine the legal protection of authors' copyrights against the sale of pirated books at that location.
This study focuses on the effectiveness of the implementation of Law Number 28 of 2014 concerning Copyright and legal efforts that can be taken against copyright infringement. The research method used is empirical juridical, data is obtained through observation, and interviews with related parties such as sellers, law enforcement officers, and literature studies along with documentation. The theoretical framework in this study includes the theory of legal protection and copyright theory.
The results of the study indicate that: First, Legal protection for copyright holders for the sale of pirated books based on Law Number 28 of 2014 at Shopping Book Yogyakarta has not provided adequate legal protection for book copyright holders. Second, the Form of Legal Responsibility that must be carried out by Copyright violators of book piracy in accordance with Law Number 28 of 2014 concerning Copyright, namely in accordance with Article 96 of Law Number 28 of 2014 concerning Copyright, there are two, namely criminal sanctions and fines or can be resolved through Article 95 Paragraph (1) of the Copyright Law, namely that the Settlement of Copyright Disputes can be carried out through arbitration, or through a commercial court.
