"The attack launched by Hamas fighters on October 7, 2023, marked a major\r\nescalation in the long standing conflict between Israel and Palestine. This sudden\r\nassault triggered a large scale military response from Israel, which then\r\nconducted intense retaliatory operations. Both Hamas and the Israeli military\r\nhave inflicted significant harm on civilians; however, Israel's counterattacks have\r\nhad the most devastating impact on the people of Gaza, particularly women and\r\nchildren. In pri nciple, civilians should never be targeted according to the\r\nprovisions of international humanitarian law. Likewise, children and women, as\r\nvulnerable groups, are entitled to special protection during armed conflicts.\r\nBased on this issue, the present study examines the extent to which the rights of\r\nwomen and children have been protected in the context of this conflict.\r\nTo address this issue, the study adopts a normative\r\nempirical legal research\r\nmethod, which assesses the implementation and application of leg al norms to\r\nspecific legal events. This approach uses a juridical empirical method to gain\r\nclarity and understanding of the issue through real world conditions, specifically\r\nvia case studies.\r\nThe findings of this study indicate that the parties involved in\r\nthe Israel Palestine\r\nconflict since October 7, 2023, have failed to fulfill their obligations to protect the\r\nfundamental rights of women and children. Furthermore, the failure of the\r\ninternational community to intervene in accordance with the Responsibili ty to\r\nProtect (R2P) mandate has instead provided implicit legitimacy and freedom for\r\nboth parties to carry out military operations. Meanwhile, efforts by international\r\ninstitutions to deliver humanitarian aid have been hindered by Israeli imposed\r\nblockades and access restrictions, rendering these efforts largely ineffective"^^ .
