%A NIM.: 21103040064 Syifa Maulida Fahmia Syihab %O Dr. Lindra Darnela, S.Ag., M.Hum %T PELINDUNGAN HAK ANAK DAN PEREMPUAN DALAM KONFLIK BERSENJATA ISRAEL ISRAEL-PALESTINA TAHUN 2023 2023-2024 %X The attack launched by Hamas fighters on October 7, 2023, marked a major escalation in the long standing conflict between Israel and Palestine. This sudden assault triggered a large scale military response from Israel, which then conducted intense retaliatory operations. Both Hamas and the Israeli military have inflicted significant harm on civilians; however, Israel's counterattacks have had the most devastating impact on the people of Gaza, particularly women and children. In pri nciple, civilians should never be targeted according to the provisions of international humanitarian law. Likewise, children and women, as vulnerable groups, are entitled to special protection during armed conflicts. Based on this issue, the present study examines the extent to which the rights of women and children have been protected in the context of this conflict. To address this issue, the study adopts a normative empirical legal research method, which assesses the implementation and application of leg al norms to specific legal events. This approach uses a juridical empirical method to gain clarity and understanding of the issue through real world conditions, specifically via case studies. The findings of this study indicate that the parties involved in the Israel Palestine conflict since October 7, 2023, have failed to fulfill their obligations to protect the fundamental rights of women and children. Furthermore, the failure of the international community to intervene in accordance with the Responsibili ty to Protect (R2P) mandate has instead provided implicit legitimacy and freedom for both parties to carry out military operations.
