N2  - The enactment of Law Number 16 of 2019 which changes the minimum age
of marriage for women from 16 years to 19 years equal to men has an impact on
applications for marriage dispensation in various Religious Courts, including the
Batang Religious Court. This study aims to analyze the impact of the regulatory
changes on the number and reasons for applications for marriage dispensation in
the period 2020-2024, and to review the relevance of this policy through the
perspective of maslahah mursalah in Islamic law.
The research method used is qualitative with an empirical juridical
approach. Data were obtained through interviews with judges and court staff as well
as data related to marriage dispensation decisions. The results of the study show a
significant downward trend in applications for marriage dispensation after the
enactment of Law Number 16 of 2019. In addition, analysis based on the review of
maslahah mursalah shows that this regulation is in line with the objectives of
protecting children and efforts to realize the welfare of society, especially in terms
of education, health, and mental readiness of couples.
The decrease in the number of marriage dispensations can be interpreted as
an indicator of the initial success of the regulation, but it is not yet socially
significant. In practice, there are still obstacles in the implementation in the field,
marked by the many cases of marriage dispensation applications that are submitted
to the Batang Religious Court. Therefore, an educational and collaborative
approach between institutions is needed to strengthen the value of the welfare
contained in the regulation so that it can be implemented optimally and sustainably
