Shohibul Adhkar, Lc., M.H. %T PENGGUNAAN APLIKASI BAJAKAN PATCH UPDATE PERSPEKTIF HUKUM POSITIF DAN HUKUM ISLAM %X The use of non-official applications remains a common phenomenon in Indonesia, primarily due to the high cost of official licenses and the ease of access to illegal software. One of the frequently used methods is patch updates from third-party distributors, which allow users to access premium features without an official license. The use of pirated software not only affects copyright and the digital economy but also poses cybersecurity risks such as malware distribution, data theft, and other cyber threats. From the perspective of positive law, this practice constitutes a copyright infringement as regulated under Law No. 28 of 2014 on Copyright and the Electronic Information and Transactions Law, subject to criminal penalties and fines. Meanwhile, in Islamic law, using pirated applications is considered an act that harms others and contradicts the principles of justice, although exceptions exist under emergency conditions based on the adl-dlarūrātu tubīḥul-maḥẓūrāt principle. This study employs a qualitative method with a normative juridical approach and comparative analysis. Data was collected through literature review, including laws, fatwas, academic journals, and other relevant legal sources. The analysis compares the regulations in positive law and Islamic law regarding the phenomenon of pirated applications, particularly in the context of patch updates. The findings indicate that while both legal systems oppose piracy, Islamic law emphasizes moral and social aspects, whereas positive law focuses more on legal certainty and economic protection for copyright holders. Additionally, this research highlights the necessity of raising public awareness regarding the negative impacts of using illegal software and the need for stricter regulations to safeguard the digital industry.
