abstract: The Presidential Advisory Council (hereinafter referred to as Wantimpres) is a state institution that has a strategic function in providing advice to the President. However, the provision regarding the absence of restrictions on the number of members in Law Number 64 of 2024 has sparked polemics and debate because it is considered to give too much authority to the President without firm action, thus potentially causing deviations from the principles of constitutionalism and not providing general benefits (maslahah mursalah). Therefore, this study aims to determine the implications of eliminating restrictions on the number of members of the Presidential Advisory Council in Law Number 64 of 2024 and to analyze the elimination of these restrictions from the perspective of maslahah mursalah. This study uses a normative legal research type with a descriptive-analytical research nature. The research approaches used are legislation, conceptual approaches, historical approaches, and comparative approaches. The sources of legal materials for this study consist of primary legal sources, namely the 1945 Constitution, Law Number 64 of 2024 concerning Amendments to Law Number 19 of 2006 concerning the Presidential Advisory Council. Secondary legal sources, used are law books, law journals, theses, and other supporting materials. The data collection technique in compiling this research is documentation.
The results of the study indicate that the absence of restrictions on the number of members of the Presidential Advisory Council has implications for the politics of favors and budget waste. The absence of restrictions on power will be vulnerable to abuse of power by the President. This makes Wantimpres only a symbolic institution with minimal strategic role but full of elitist interests. Therefore, this study recommends that Wantimpres continue to carry out its duties as an advisor to the President but still have restrictions on the number of members and maintain the principle of checks and balances as a state institution while still considering aspects of general welfare
