The issue arises from concerns over the misuse of the open legal policy doctrine, which allows the Constitutional Court to intrude into the legislative domain. This research is guided by two main questions: How does the Constitutional Court interpret open legal policy in Decision Number 112/PUUXX/ 2022 and How is this interpretation viewed from the perspective of fiqh siyasah tasyri’iyyah. This study uses a normative juridical method with a statutory and case approach. Data were collected through library research of laws, books, journals, and relevant legal documents. The research is descriptive-analytical and focuses on normative analysis of the Constitutional Court’s decision and its relevance to Islamic legal principles from the siyasah tasyri’iyyah perspective. The findings show that the Constitutional Court has expanded the interpretation of open legal policy beyond its legitimate authority as a negative legislator. This blurs the line between legislative and judicial functions and creates a potential conflict of interest, especially since the decision benefits the current KPK leadership. A literature review of various journals and dissertations supports these concerns, highlighting similar critiques in previous rulings.
