N2  - This study aims to analyze the problems and existence of Constitutional Court Decision Number 37/PUU-XIX/2021 regarding the management of mineral and coal mining from the perspective of siyasah qadhaiyyah and mining law politics. This study explores regulatory aspects of mining aimed at promoting public welfare as mandated by Article 33 of the 1945 Constitution. However, the decision has raised various challenges, including overlapping authority, minimal environmental protection, and legal uncertainty for affected communities. Consequently, some petitioners filed another judicial review of the problematic articles. Therefore, this study addresses two main questions: first, what are the problems in Constitutional Court Decision Number 37/PUU-XIX/2021 regarding the management of mineral and coal mining? Second, what is the existence of Constitutional Court Decision Number 37/PUU-XIX/2021 on the management of mineral and coal mining from the perspective of siyasah qadhaiyyah?
This research employs a descriptive-analytical method with a juridical-normative approach, referring to primary legal materials such as Constitutional Court decisions and secondary and tertiary legal materials. The theories used include mining law politics and siyasah qadhaiyyah, providing an evaluative framework for justice, public benefit, and protection of community rights.
The results indicate that while Constitutional Court Decision Number 37/PUU-XIX/2021 serves as a significant basis for reconstructing mining regulations, it has not fully aligned with the principles of sustainability and public welfare. Both theories?mining law politics and siyasah qadhaiyyah?emphasize the need for a more equitable legal approach that considers social justice, environmental protection, and local community involvement.
