"The choice of premium packages for the Spotify application at relatively\r\nexpensive prices presents individuals who sell at a lower price. The public as the\r\nmain consumer prefers to buy premium spotify pirated application services\r\nthrough third parties because of the cheaper price and the features provided are\r\ncomparable to the official features of spotify. To purchase premium spotify\r\npirated app services, the buyer generally makes an agreement regarding the\r\ncontract given at the beginning of the purchase. However, in practice, cases of\r\nfraud and uncertainty in the buying and selling process often occur at the time of\r\nthe transaction so that many buyers are deceived and disappointed regarding the\r\nsale of pirated application services.\r\nThis study aims to describe the practice of buying and selling premium\r\nspotify pirated application services reviewed with Islamic law and positive law.\r\nThis type of research is field research with an empirical-normative approach and\r\ndata collection techniques in the form of interviews and questionnaires. There\r\nwere 107 respondents and 5 informants as the main data in accordance with the\r\nmain problem being studied. The analysis carried out in this study uses inductivequalitative\r\ntechniques by obtaining factual data and being linked to existing\r\ntheories.\r\nThe results of this study show that people who buy premium spotify pirated\r\napplication services are mostly deceived after making payments with a\r\ndiscrepancy between the email and password provided and the seller's response is\r\nunresponsive, the warranty provided is not appropriate making the public\r\ndisappointed and deceived. In addition, the use of personal emails and passwords\r\nmakes it vulnerable to hacking. In buying and selling in accordance with Islamic\r\nlaw, the practice is not in accordance with one of the conditions for buying and\r\nselling. According to positive law, regarding the conditions for the validity of the\r\nagreement, one of the subjective and objective conditions is not met, so that the\r\nlaw can be canceled and nullified for the sake of the law."^^ .
