"The development of digital technology has significantly facilitated the\r\ndissemination of written works across various social media platforms, while\r\nsimultaneously posing serious challenges to copyright protection. On one hand, the\r\npublic gains easier access to and use of written content; on the other hand, creators\r\nare increasingly harmed by unauthorized use and lack of proper attribution. This\r\nphenomenon creates a contradiction between two forms of maṣlaḥah: the maṣlaḥah\r\nof protecting the creator’s exclusive rights and the maṣlaḥah of public access to\r\nwritten works. Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta\r\nconcerning Copyright introduces the concept of fair use, yet its provisions have not\r\nadequately addressed the complexities of copyright infringement in the digital era.\r\nThis study is guided by three main research questions: How is the concept of fair\r\nuse applied in protecting written works in the digital age according to Indonesian\r\nregulations; Why does the fair use concept under Indonesian Copyright Law remain\r\nineffective in preventing infringement; And how can the concept of maṣlaḥah be\r\napplied to balance the conflict between these two competing interests.\r\nThis research adopts a normative-cum-empirical method using a statutory\r\napproach and a case-based approach. The theories used include the theory of\r\nexclusive rights—comprising both moral and economic rights under copyright\r\nlaw—the doctrine of fair use, and the theory of maṣlaḥah. Data were obtained\r\nthrough legal literature studies, analysis of relevant laws and regulations, as well as\r\ncase studies on copyright infringement of written works through social media\r\nplatforms.\r\nThe findings research reveal that the application of fair use in Indonesian\r\nCopyright Law lacks sufficient normative boundaries, rendering it vulnerable to\r\nmisuse in ways that violate the exclusive rights of authors. The absence of\r\ntechnological standards for the digital protection of written works further reduces\r\nthe effectiveness of current laws. Conversely, the principle of maṣlaḥah offers a\r\nnormative approach that can help assess and reconcile the conflict between these\r\ntwo competing maṣlaḥah. Therefore, the integration of the maṣlaḥah principle into\r\ncopyright policy is essential to achieve a fair balance between protecting the\r\nexclusive rights of creators and ensuring public access to knowledge."^^ .
