On one hand, the public gains easier access to and use of written content; on the other hand, creators are increasingly harmed by unauthorized use and lack of proper attribution. This phenomenon creates a contradiction between two forms of maṣlaḥah: the maṣlaḥah of protecting the creator’s exclusive rights and the maṣlaḥah of public access to written works. Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta concerning Copyright introduces the concept of fair use, yet its provisions have not adequately addressed the complexities of copyright infringement in the digital era. This study is guided by three main research questions: How is the concept of fair use applied in protecting written works in the digital age according to Indonesian regulations; Why does the fair use concept under Indonesian Copyright Law remain ineffective in preventing infringement; And how can the concept of maṣlaḥah be applied to balance the conflict between these two competing interests. This research adopts a normative-cum-empirical method using a statutory approach and a case-based approach. The theories used include the theory of exclusive rights—comprising both moral and economic rights under copyright law—the doctrine of fair use, and the theory of maṣlaḥah. Data were obtained through legal literature studies, analysis of relevant laws and regulations, as well as case studies on copyright infringement of written works through social media platforms. The findings research reveal that the application of fair use in Indonesian Copyright Law lacks sufficient normative boundaries, rendering it vulnerable to misuse in ways that violate the exclusive rights of authors. The absence of technological standards for the digital protection of written works further reduces the effectiveness of current laws. Conversely, the principle of maṣlaḥah offers a normative approach that can help assess and reconcile the conflict between these two competing maṣlaḥah.
