description: Inter-sect marriage between Sunni and Shia Muslims in  Indonesia occupies a gray area within both Islamic jurisprudence and  state law. Classical Shafi’i jurisprudence requires theological  congruence as a prerequisite for the validity of marriage, whereas Law  No. 1 of 1974 and the Compilation of Islamic Law do not explicitly  regulate sectarian affiliation. In practice, however, implementation  often hinges on exclusive institutional interpretations. Amid this legal  ambiguity, inter-sect marriages in Bondowoso continue to be practiced  both socially and institutionally.  This study raises core questions regarding how the law is  understood, interpreted, and enacted by both communities and  institutions; how legal dynamics are experienced by inter-sect couples;  how the state and religious authorities respond to the challenges of  such marriages; and to what extent these practices influence socioreligious  dynamics and intergroup relations within society.  Adopting a socio-legal framework with a socio-anthropological  emphasis, the research draws on in-depth interviews with Sunni-Shia  couples, officials from the Office of Religious Affairs (KUA), judges  and staff from the Religious Courts, as well as leaders from Nahdlatul  Ulama (NU), Muhammadiyah, the Indonesian Ulema Council (MUI),  and the Forum for Religious Harmony (FKUB), alongside members  of the general public. The study also incorporates direct observations  of religious activities conducted in Jambesari and Kademangan  between 2020 and 2024. Documents analyzed include marriage  records from the KUA, counseling guidelines, institutional fatwas and  decisions, and local documents relating to religious and familial social  practices among inter-sect communities. The data were analyzed using  a theoretical framework that integrates structural, conflict, and social  hermeneutic approaches to explore the interactions between law,  religion, and society. The findings reveal that Sunni, Shia couples in Bondowoso  firmly believe that their marriages are legally valid. They explicitly  distinguish between interfaith marriages, perceived as contradictory to  Islamic law, and inter-sect marriages, which, in their understanding,  remain valid as both parties are Muslims. These couples tend to align  with scholarly views that are more accommodating of sectarian  differences. The marriages are categorized into two main patterns:  those between local inter-sect individuals and those involving partners  from outside the region or of foreign descent. This diversity shapes  family dynamics, including communication strategies, management of  ritual differences, and approaches to child education.  The KUA in Bondowoso does not contest the status of such  marriages, registers them administratively, and even provides  specialized counseling for inter-sect couples. The Religious Courts  also refrain from highlighting sectarian differences in resolving family  disputes, instead focusing on general marital issues. The presence of  these practices contributes to easing intergroup tensions and  strengthening social cohesion. Despite the potential for conflict arising  from sectarian differences, these marriages have opened spaces for  dialogue, reinforced religious moderation, and emerged as a familybased  conflict resolution model that can inform the development of  contextual Islamic law.
