"Inter-sect marriage between Sunni and Shia Muslims in\r\nIndonesia occupies a gray area within both Islamic jurisprudence and\r\nstate law. Classical Shafi’i jurisprudence requires theological\r\ncongruence as a prerequisite for the validity of marriage, whereas Law\r\nNo. 1 of 1974 and the Compilation of Islamic Law do not explicitly\r\nregulate sectarian affiliation. In practice, however, implementation\r\noften hinges on exclusive institutional interpretations. Amid this legal\r\nambiguity, inter-sect marriages in Bondowoso continue to be practiced\r\nboth socially and institutionally.\r\nThis study raises core questions regarding how the law is\r\nunderstood, interpreted, and enacted by both communities and\r\ninstitutions; how legal dynamics are experienced by inter-sect couples;\r\nhow the state and religious authorities respond to the challenges of\r\nsuch marriages; and to what extent these practices influence socioreligious\r\ndynamics and intergroup relations within society.\r\nAdopting a socio-legal framework with a socio-anthropological\r\nemphasis, the research draws on in-depth interviews with Sunni-Shia\r\ncouples, officials from the Office of Religious Affairs (KUA), judges\r\nand staff from the Religious Courts, as well as leaders from Nahdlatul\r\nUlama (NU), Muhammadiyah, the Indonesian Ulema Council (MUI),\r\nand the Forum for Religious Harmony (FKUB), alongside members\r\nof the general public. The study also incorporates direct observations\r\nof religious activities conducted in Jambesari and Kademangan\r\nbetween 2020 and 2024. Documents analyzed include marriage\r\nrecords from the KUA, counseling guidelines, institutional fatwas and\r\ndecisions, and local documents relating to religious and familial social\r\npractices among inter-sect communities. The data were analyzed using\r\na theoretical framework that integrates structural, conflict, and social\r\nhermeneutic approaches to explore the interactions between law,\r\nreligion, and society. The findings reveal that Sunni, Shia couples in Bondowoso\r\nfirmly believe that their marriages are legally valid. They explicitly\r\ndistinguish between interfaith marriages, perceived as contradictory to\r\nIslamic law, and inter-sect marriages, which, in their understanding,\r\nremain valid as both parties are Muslims. These couples tend to align\r\nwith scholarly views that are more accommodating of sectarian\r\ndifferences. The marriages are categorized into two main patterns:\r\nthose between local inter-sect individuals and those involving partners\r\nfrom outside the region or of foreign descent. This diversity shapes\r\nfamily dynamics, including communication strategies, management of\r\nritual differences, and approaches to child education.\r\nThe KUA in Bondowoso does not contest the status of such\r\nmarriages, registers them administratively, and even provides\r\nspecialized counseling for inter-sect couples. The Religious Courts\r\nalso refrain from highlighting sectarian differences in resolving family\r\ndisputes, instead focusing on general marital issues. The presence of\r\nthese practices contributes to easing intergroup tensions and\r\nstrengthening social cohesion. Despite the potential for conflict arising\r\nfrom sectarian differences, these marriages have opened spaces for\r\ndialogue, reinforced religious moderation, and emerged as a familybased\r\nconflict resolution model that can inform the development of\r\ncontextual Islamic law."^^ .
