"Law Number 4 of 2024 concerning the Welfare of Mothers and Children in the First\r\nThousand Days of Life is a law that regulates several rules, one of which is the rule\r\non maternity leave. The maternity leave rules in the Maternal and Child Welfare\r\nLaw theoretically have a positive impact on the fulfillment of both physical and\r\nmental well-being for mothers and children. However, in the context of gender, the\r\nmaternity leave rules in the Maternal and Child Welfare Law have a negative\r\nimpact with the affirmation of the concept of female domestication. The concept of\r\nfemale domestication itself is a form of discrimination that the state is trying to\r\neliminate, in accordance with the objectives (maqāṣid) mandated in the 1945\r\nConstitution. This study aims to describe the accommodation of gender equality\r\nvalues related to the maternity leave rules in the Maternal and Child Welfare Law,\r\nand then analyze them from the perspective of Feminist Legal Theory and Maqāṣid\r\nal-Syarī‘ah.\r\nThis study uses qualitative research. This research is descriptive analytical, aiming\r\nto describe the accommodation of gender equality values related to maternity leave\r\nregulations in the Maternal and Child Welfare Law. The approach used is a genderbased\r\napproach and maqāṣid al-Syarī‘ah. Primary data sources were obtained\r\nfrom various libraries/literature related to gender and the Maternal and Child\r\nWelfare Law, while secondary data came from international conventions, especially\r\nthose related to gender and Human Rights. Data collection techniques used\r\nliterature studies, while data analysis techniques used qualitative data analysis.\r\nThe results of this study conclude that the values of gender equality have been\r\naccommodated in the Maternal and Child Welfare Law. However, from the\r\nperspective of feminist legal theory, there are still forms of gender bias related to\r\nthe maternity leave regulations in the Maternal and Child Welfare Law. The\r\nexistence of these forms of gender bias is an implication of the selection of Cultural\r\nFeminism values as the foundation of the maternity leave regulations in the\r\nMaternal and Child Welfare Law. On the other hand, from the perspective of\r\nmaqāṣid al-Syarī‘ah, the maternity leave regulations in the Maternal and Child\r\nWelfare Law are at the al-ḍarūriyyāt (primary) level.
