N2  - Marriage renders the relationship between man and woman can be involved with respect. It is legalized to unite and grows the affection. However, currently the meaning of it is applied differently by committing adultery before marriage. This sometimes leads to pregnancy. Whereas, pregnancy out of wedlock is seen dishonor and moral violation by society perspective. Based on Article 53 of Compilation of Islamic Law (KHI) regulates that a woman who is pregnant out of wedlock can be married to the man who impregnated her. This phenomenon is frequently rampant in SRITI Village which associated to its thick religion and kejawen, local culture. Within the past 3 years (2022-2024) SRITI documented 19 cases of marriage by pregnancy. This thesis asks two research question; first, how the rise of marriage by pregnancy happens in SRITI local community and the last, how local community views on marriage by pregnancy in SRITI.
This research was compiled through empirical study within descriptive analytic method using phenomenology approach which is introduced to understand social phenomena in living society. This research relies on primary source through interview and secondary source from articles and books that are relevant. In conclusion, the data were collected through interview, observation, and documentation.
This study concludes several things. Firstly, the main reason of marriage due to pregnancy SRITI local community is the internal factor of individual self being who do not have strong religious background, lack of parental control or supervision, promiscuity, and social media. Secondly, local community outlooks of marriage by pregnancy divided into several views. Some of them considerate it as taboo while the others presume it?s miserable because of the increasing phenomenon. However, a few think otherwise, marriage due to pregnancy has become common thing. In addition, the local community?s perspective on the aim of marriage by pregnancy is analyzed using Alfred Schutz?s phenomenology. Schutz argues that every human behavior has purpose. This purpose is linked to individual action which is order to motive. Motive behind this phenomenon among SRITI local community is to cover up the disgrace and ensure the child has status upon birth and for the administrational purpose, the name of biological father is listed on the birth certificate.
