        abstract = {Inheritance is the transfer of inherited property from a person who has passed away to their heirs. The inherited property must be given to the heirs according to their shares. However, disputes often occured during this process, as in decisions 882/Pdt.G/2019/PA.Kds and 262/Pdt.G/2020/PTA.Smg. The author is interested in researching this issue with the title ?Analysis of judgment 882/Pdt.g/2019/PA.Kds and 262/Pdt.G/2020/PTA.Smg on inherited property that has been sold?. The research questions posed in this study are: 1) What are the legal basis and considerations based on the judges decisions in judgment 882/Pdt.G/2019/PA.Kds and 262/Pdt.G/2020/PTA.Smg on inherited property that has been sold? 2) How are court judgnment 882/Pdt.G/2019/PA Kds and 262/Pdt.G/2020/PTA Smg compatible with the principles of legal certainty, justice, and utility?
This thesis is a normative legal study using a statute approach. The theoretical framework of this thesis is based on the legal principles by Gustav Radbruch: certainty, justice, and utility. The legal principles provide the basis for analyzing both court judgment.
The research result concludes that there were differences in the legal basis used by judges in determining the inherited property that had been sold. Decision of Religious Court attempts to provide the rights of the heirs, howover, it is lacks certainty and justice for third parties. In the other way, decision of the high religious court provides certainty, justice, and utility by separated inheritance and ownership disputes, which provides more comprehensive protection for all parties.}
