abstract: Child marriage conducted by prospective husbands/wives who are under 19 years old is basically illegal according to the law. Although it is generally not allowed, according to Article 7 paragraph (2) of Law Number 16 of 2019, there is still a possibility of deviation from the age of 19 years as a requirement for marriage, by submitting a petition for exemption to the Religious Court with very urgent reasons, accompanied by sufficient supporting evidence. What is meant by 'very urgent reasons' is a situation where there is no other choice but to carry out the marriage. The Madiun City Government continues to strive to reduce the number of marriages at a young age. One of the efforts made by the Madiun City Government is the establishment of Madiun Mayor Regulation Number 18 of 2022 on Preventing Child Marriage.
The issues studied in this research include: (1) How is the Implementation of the Mayor of Madiun Regulation Number 18 of 2022 on Preventing Child Marriage in the Granting of Marriage Dispensation at the Religious Court of Madiun City, (2) What are the factors hindering the Implementation of the Mayor of Madiun Regulation Number 18 of 2022 on Preventing Child Marriage in the Granting of Marriage Dispensation at the Religious Court of Madiun City. This research is a qualitative study that is descriptive and analytical in nature. Data collection techniques include interviews, observations, and documentation. The approach used is an empirical legal research approach, which is a legal research method that utilizes facts in the form of experiences from human behavior, both verbal behavior obtained from field studies, interviews, and literature studies.
Based on the findings of this research, it can be concluded that the implementation of Madiun Mayor Regulation Number 18 of 2022 on the Prevention of Child Marriage in the issuance of marriage dispensations at the Madiun Religious Court has already taken place, although it is not yet optimal. This is due to the lack of provisions in Madiun Mayor Regulation Number 18 of 2022 that contradict higher hierarchical regulations. The existence of this regulation complements the existing regulations. Factors hindering the implementation of Madiun Mayor Regulation Number 18 of 2022 on the Prevention of Child Marriage in the issuance of marriage dispensations at the Madiun Religious Court include that socialization from the Madiun City government has not been optimally conducted. The factor of early pregnancy is a very urgent situation that becomes a significant consideration for judges in granting marriage dispensations.
