This of course causes the consumers some loss, hence, in this research there are some cases discussed: 1) How is the preservation of the consumers’ rights regarding the expired food according to the Law No. 8 year 1999 about the Preservation of Consumers’ Rights? 2) What effort should be taken by the businessmen in order to prevent the distribution of the expired food and drink? The method utilized in this research is empirical juridic method which is qualitative. The source of the data consists of the primary data, namely the results of interviews, and the secondary one, namely the source of primary law data. The method of collecting the data is by the library study and field study (interviews), and therefrom the data is analysed qualitatively. The master plan of the theory in this research is the Consumers’ Rights Preservation theory and the theory of Maqasid Syari’ah. In the theory of law preservation, transgression may cause injustice and uncertainty of law. Therefore, any effort should be taken to establish the law, of which is qualitatively through the Consumers’ Rights Preservation Law, and other laws, whether regarding the private law, or public law. And as for the Maqasid Syari’ah, it is in order to guard and protect the affairs and rights of mankind, including the protection of the religion, soul, mind, offspring, and wealth. And in the context of food, Maqasid Syari’ah encourage the availability of halal warranty of the product, the safety of food, and likewise justice in the sales transaction.
