%T ANALISIS YURIDIS URGENSI SURAT KETERANGAN CATATAN KEPOLISIAN (SKCK) SEBAGAI SYARAT ADMINISTRATIF PENCALONAN ANGGOTA LEGISLATIF DI INDONESIA
%X Elections serve as a means to realize the sovereignty of the people. However, in practice, individuals with criminal records particularly those convicted of corruption—are still able to run as legislative candidates. One controversial case involves former corruption convicts who re-enter politics after serving their sentence, raising public concerns about the integrity of legislative institutions. This research aims to analyze the urgency of requiring a Police Clearance Certificate (Surat Keterangan Catatan Kepolisian, or SKCK) as a screening mechanism for prospective legislative candidates with criminal histories.
This thesis uses a library research type with a normative juridical approach and a statutory approach. Data collection in this thesis uses sources consisting of primary legal materials, secondary legal materials, and tertiary legal materials. The author also uses a descriptive- analytical research nature, namely the author seeks and collects data related to policies related to case studies of the Supreme Court Decision Number 46 P/HUM/2018. This study also examines the principles of election law that uphold morality and justice.
The research results indicate that a Police Clearance Certificate (SKCK) can be a control tool to prevent individuals with serious criminal convictions from entering legislative bodies. However, there is still a legal gap that does not explicitly require a Police Clearance Certificate (SKCK) in the legislative nomination process. The authors recommend amending election regulations to require a Police Clearance Certificate (SKCK) as an administrative requirement for candidacy, particularly for former convicts. This is in line with efforts to maintain the integrity of representatives and strengthen public trust in the democratic system.
