This practice is commonly encountered in the field, including in the Nologaten area of Yogyakarta, and is carried out by some drivers with the intention of manipulating their location to gain easier access to orders. The existence of such applications reveals a systemic loophole exploited by users, while simultaneously raising legal and ethical concerns within the context of modern economic transactions (muamalah). This study aims to examine the legal and Islamic business ethics aspects of the use of non-genuine applications by ShopeeFood drivers, by observing the social realities on the ground and relating them to applicable normative frameworks. This research employs a qualitative method with a juridical-ethical approach. Data were collected through field observations and interviews with ShopeeFood drivers in the Nologaten area, along with a review of legal regulations such as Law Number 19 of 2016 concerning Electronic Information and Transactions (ITE Law). Additionally, the author uses Islamic business ethics theory as a normative analytical framework to evaluate competition practices within the digital space. This approach allows for a comprehensive analysis that integrates formal legal dimensions with ethical values in Islam, such as honesty, justice, and responsibility. The findings indicate that the use of non-genuine applications constitutes a violation of positive law and undermines the principles of Islamic business ethics. This practice creates inequality among drivers, disrupts the order distribution system, and can be classified as a form of information manipulation prohibited under the ITE Law. From an Islamic perspective, such actions breach the principles of a valid contract (akad), as well as the values of honesty and fair competition. The study recommends the need for stricter enforcement of digital regulations and the promotion of business ethics among digital economy actors in order to establish a just and sustainable muamalah system. date: 2025-08-12 date_type: published pages: 121 institution: UIN SUNAN KALIJAGA YOGYAKARTA department: FAKULTAS SYARI’AH DAN HUKUM thesis_type: skripsi thesis_name: other citation: Khoiri Rahman, NIM.: 20103080027 (2025) TINJAUAN HUKUM TERHADAP PENGGUNAAN APLIKASI FAKE GPS OLEH DRIVER SHOPEEFOOD (STUDI KASUS PADA DRIVER SHOPEEFOOD DI JALAN NOLOGATEN, YOGYAKARTA).
