N2  - Sexual violence against women and minors is a crucial issue in Indonesia, classified as a gross human rights violation with profound multidimensional impacts on victims, families, and social structures. Data shows that Indonesia is facing a sexual violence emergency, with a significant increase in cases every year; however, the high number of unreported cases due to stigma and fear among victims indicates a larger problem, resembling the "tip of the iceberg" phenomenon. Therefore, this study aims to analyze the legal provisions for sexual violence against women and minors in the Indonesian criminal justice system following the enactment of Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence (UU TPKS), and to identify the best solutions to minimize the occurrence of this crime.
This research uses a normative or doctrinal legal research method, which focuses on literature review and analysis of laws and regulations. The descriptive
analytical nature of the research allows for a thorough description of the phenomenon of sexual violence, including statistical data, case patterns, and legal regulations. This research then conducts in depth analysis to identify causal relationships, legal implications, and criminological factors underlying the problem. Data analysis is conducted descriptively and qualitatively, using interpretation methods to understand the meaning of legal norms, systematization to see the relationships between regulations, and legal argumentation to develop answers to the problem formulation.
This study will evaluate the implementation of the TPKS Law by law enforcement officials and related service agencies, identifying solutions to obstacles and challenges in inter agency coordination, the availability of implementing regulations, and human resource capacity. The discussion will also cover the gap between ideal legal norms and the reality of law enforcement on the ground, as well as its impact on victim protection and recovery.
