However, in practice, third-party management of such lands encounters several legal issues, including differing interpretations of agreements, the fulfillment of rights and obligations of each party, potential disputes, and conformity with prevailing legal provisions. In addition, challenges remain, such as inconsistencies between land locations and spatial planning, as well as widespread community use of the land without official authorization. This study employs a descriptive-analytical qualitative approach within the framework of empirical juridical research. A statutory approach is applied to examine the relevant regulations on the management and utilization of Sultanate and Duchy lands. Data were collected through direct interviews with the Sultanate authorities, third parties utilizing the land, and through documentation of land management agreements, supported by literature studies from various primary and secondary legal sources. The utilization of Sultanate and Duchy lands in Yogyakarta reveals fundamental differences. While the Sultanate lands are governed by a relatively clear legal framework, the Duchy lands lack formal agreements that should ordinarily define the parties’ identities, the object of the agreement, the parties’ respective rights and obligations, the duration, and the mechanisms for dispute resolution. The absence of a written agreement creates an imbalance in legal standing: the Duchy retains full ownership rights, whereas the community only holds de facto possession without a lawful basis.
