%X The circulation of alcoholic beverages in the Special Region of Yogyakarta is increasingly uncontrolled. The large number of unlicensed alcoholic beverage sellers and the increase in crime due to the influence of alcoholic beverages have become serious problems that have an impact on public security and recognition. The Provincial Government of the Special Region of Yogyakarta in response to this problem issued Governor's Instruction Number 5 of 2024 concerning Optimization of Control and Supervision of Alcoholic Beverages. This instruction is given to the Regent and Mayor to optimize the control and supervision of alcoholic beverages in their respective areas in providing protection, maintaining peace, and public order. In this study, the author examines the optimization of control and supervision of alcoholic beverages in the City of Yogyakarta as a follow-up to Governor's Instruction Number 5 of 2024 and the inhibiting factors in its implementation.
The type of research used is field research (field study), with an empirical legal approach method in analyzing legal materials which are secondary data and primary data obtained in the field. This research is descriptive analytical, data obtained from interviews and documentation with several related agencies such as the DIY Legal Bureau, the Yogyakarta City Legal Section, the Yogyakarta City DPMPTSP, and the Yogyakarta City Satpol PP. Data analysis was conducted through Lawrence M. Friedman's legal system approach and policy implementation theory.
The results of this study conclude that the implementation of optimization of control and supervision of alcoholic beverages in the City of Yogyakarta has been running quite well in accordance with Governor's Instruction Number 5 of 2024. The form of effort made by the Yogyakarta City Regional Government is by conducting an inventory of business actors, carrying out law enforcement and enforcement, forming and optimizing time, involving the role of the community, and evaluating regional legal products. In its implementation, there are several obstacles, namely, there are several business actors who open their businesses openly, most consumers are young people, alcoholic beverages sold in stores consist of various brands with varying alcohol content, lack of good coordination between regional devices, business actors who do not have a hidden operating permit, the difficulty of supervising business actors and consumers who transact online, and limited internal resources and alcoholic beverages.
