%A NIM.: 21103050004 Nauval Ibnu Aziz %O Yasin Baidi, S.Ag., M.Ag. %T KYAI SEBAGAI WALI DALAM PERNIKAHAN DI DESA BUMIANYAR KECAMATAN TANJUNGBUMI KABUPATEN BANGKALAN JAWA TIMUR %X The role of kyai as a marriage guardian (wali) in Bumianyar Village, Tanjungbumi Sub-district, Bangkalan Regency, does not strictly follow the formal Islamic legal order of lineage-based guardianship (wali nasab). This study examines the social and religious practices embedded within Madurese society, particularly in relation to the kyai's religious and moral authority. The core issues addressed include the reasons behind the community’s adherence to this tradition and its analysis through the lens of maslahah mursalah. This research is a field study with a descriptive-analytical approach. Data were collected through in-depth interviews with community members, village leaders, and kyai, as well as through documentation. The collected data were analyzed qualitatively using an inductive method, with conclusions drawn using a normative approach rooted in Islamic law, particularly through the perspective of maslahah mursalah. The findings reveal that the community’s appointment of a kyai as wali is not merely due to the absence of a lineage guardian, but is primarily based on trust, respect, and the belief that the kyai will safeguard the integrity and benefit of the marriage. From the perspective of maslahah mursalah, this practice is acceptable as it aims to preserve social stability, ensure the validity of marriage, and prevent harm. The study concludes that the practice of appointing a kyai as wali can be considered socially legitimate and justifiable under Islamic law through the maslahah mursalah approach, as long as it does not contradict the fundamental principles of the Sharia. %K Kyai, Wali Nikah, Maslahah Mursalah, Hukum Islam %D 2025 %I UIN SUNAN KALIJAGA YOGYAKARTA %L digilib74240
